Zim24News can exclusively reveal that Henrietta Rushwaya retains the ZimbabweMiners Federation Presidency after submitting an application at the Supreme Court for stay of execution and reinstatement of her appeal of 4th April 2019 that was made in terms of Rule 70 (2) as read with rule 17 (12) of the Supreme Court rules 2018.
In her application for stay of execution Rushwaya through her lawyers applies to be condoned for failure to comply with Rule 17 sub Rule 11 of the Supreme Court rules 2018.She also appeals to reinstate her appeal filed on the 4th of April 2019 which had been deemed to be abandoned for failure to inspect the record of appeal within the stipulated period. She further contends that her failure to inspect the record of appeal ” was neither willful nor deliberate as she wasn’t aware that she had been invited to inspect the record of appeal until the 1st of July 2019″
Commenting on the issue ZMF PR Manager Dosman Mangisi said.”Contrary to what has been circulating in other media circles, the latest Supreme Court application for stay of execution means Rushwaya is still at the helm.No one is dethroned . Its only a judge who can dismiss or uphold an appeal and in this case we are still waiting for the rulling on her appeal.
